If the premises has anything to do with food preparation, it is very illegal. Zoning restrictions for other situations will vary greatly. In this economy, if it doesn’t compromise the integrity of the structure, I doubt the landlord will force a vacancy. If you own the building, a landlord tenant dispute could be very interesting.

That depends on your zoning bylaws. You may be able to have the property rezoned for residential/commercial.
